■ Terms of Use
TOTAL Workout (hereinafter referred to as “the Club”) would request for you to follow the following matter, so that all members are able to use the Club comfortably.

The utilization of the Club shall be limited to those who are not prohibited by their doctors from participating in physical activities. Also, those who are under 20 years of age must have the parents’ approval.

The Club’s business hours are governed in the “Guidance for application and use”. (* see “Guidance for application and use” separately)

The Club shall be closed during the year-end and New Year holidays, and due to unavoidable circumstances, such as statutory inspections and repairs of the Club facility.

Please keep your valuables at your responsibility. The Club may not be able to keep or look after you valuables. The Club shall not be responsible for any damages from theft, injury, or other accidents.

The Club prohibits items below
1 | Consumption of food and/or smoking in unauthorized areas. |

2 | Training under the influence of alcohol |
3 | Facility use with an external injury, skin disease, or infectious disease. |
4 | Bringing food or beverages, hazardous materials, or pets onto the Club premises. |
5 | Any act that inconveniences other guests, including gambling, solicitation, sales activities, and any other similar acts. |
6 | Unauthorized photography, audio and video recording. |
7 | Unauthorized requests for another member's cooperation in answering questionnaires. |
8 | Any act that defames or slanders others. |
9 | Violent or threatening behavior against others |
10 | Any act that offends public order and morals, including sexual harassment, voyeurism, and sexual exposure. |
11 | Writing graffiti on the building or interior of the club facilities. |
12 | Utterance of violent remarks while using the Club. |
13 | Excessive noise or vibrations from intentionally dropping any kind of equipments on the floor. |
14 | Entrance to the unauthorized area. |
15 | Any act considered as business interference. |
16 | Changing the Club facility installations and settings (including but not limited to ventilation, lightings, sounds, and audio equipments) without getting the Club’s authorization |
17 | Solicitation of retirement for employees and stakeholders of this Club, employment placement to other companies, withdrawal and other similar acts. |
18 | Any other acts in contravention of the purposes of the Club. |

Act of business, distributing religious or political handbill or any other printed handbills are prohibited within or outside of the Club, unless the Club gives special permission to do so.

The Club regrettably declines your offer to give tips to our employees.

Please pay attention to the following matters when using the locker room.
1 | When using the locker room, be sure not to give trouble for other customers. |

3 | A bench is for everyone to use. |
4 | Please make sure you have not left your belongings when you leave the locker room. |
5 | Especially, please double check to see your watch, ring, pierce, and other accessories. |
6 | The Club request for you to refrain from using audio player, listening to music with sound, or using cell-phone in the locker room. |
7 | The Club request for you to refrain from touching or opening cabinets in the locker room. |
8 | Please notify our staff when suspicious item were found in the locker room. |
9 | Pleas throw your trash away in the trash box. |
10 | The Club request for you to refrain from touching or operating air-conditioner or electricity. Please let our stuff know any malfunction. |
11 | The Club request for you to refrain from putting dangerous substances, pet, fresh food, and other smelly substances in the locker. |
12 | Please do not leave your used towel or shirt untouched. |
13 | The Club request for you to use the dresser clean for others to use next. |
14 | The Club request for you to use hair drier and tissue paper clean for others to use next. |
15 | Please notify the Club staff immediately, when you do not feel well. |
16 | Please return your rental towel, clothing, and shoes to the front desk. |
■ Terms of Membership
Article 1 (Name)
The name of the facility is “TOTAL Workout” (hereinafter referred to as “the Club”).
Article 2 (Main operation body)
The Club is operated by Fields Corporation(16-17 Nampeidai-cho, Shibuya-ku, Tokyo; hereinafter referred to as “Our company”).
Article 3 (Purpose)
The purposes of the Club are to improve the basic physical strength and human power of Club members and to maintain and promote the health of such members.
Article 4 (Membership Requirements)
TThe Club will welcome those individuals and organizations who agree to the purposes of the Club and approve the membership regulations. The utilization of the Club shall be limited to those who are not prohibited by their doctors from participating in physical activities. Also, those who are under 20 years of age must have the parents’ approval.
Article 5 (Membership Categories)
1 The Club’s membership categories and rights are governed in the “Guidance for application and use”. (* see “Guidance for application and use” separately)
2 If necessary, we may create new membership categories and/or abolish existing membership categories. In such cases, notice shall be posted in, our company’s internet HP, prominent places in the facility of the Club, and/or in documentation
Article 6 (Membership Process)
To join the Club, an applicant shall complete the designated application form and go through the required membership process together with the payment of the membership fee. (* see "About membership process" separately)
Article 7 (Procedures)
Members are required to complete the necessary procedures in an orderly manner for the change of membership categories and upon expiration of the term of contract for the private locker and etc. Members are also required to immediately go through the necessary procedures in the event of any change to the entries made on the application form (including, but not limited to, change of address). In this case, notification of such change shall become effective upon the completion of the necessary paperwork by the Club.
Article 8 (Registration Fee, Membership Fee, Ticket Fee)
1 The Club member must pay their registration fee, membership fee, and/or ticket fee by the Club’s appointed manner.
2 In case your membership fee is not withdrawn, due to improper bank account or balance shortage in account, we may withdraw this fee on the following month.
3 Regardless of not using the club, club member must make one’s payment for monthly membership fee, until one is officially withdrawn from the club.
4 Once paid, registration fee, membership fee, and ticket fee shall not be refunded for any reason whatsoever
Article 9 (Membership Card)
1 A membership card shall be issued to individual members, as identification as a Club member.
2 Club member must present one’s membership card, upon using the Club facilities.
3 The membership card shall be valid only for the holder of the card.
Article 10 (Tickets)
1 Personal Training shall be provided by a ticketing system.
2 Members may not transfer or resell purchased ticket to others.
3 Once paid, ticket fee shall not be refunded for any reason whatsoever (regardless of using or not using the ticket)
Article 11 (Procedures for withdrawal)
A member who intends to withdraw from the Club shall submit the prescribed notice of withdrawal by the deadline designated by the Club. Also, one must return its’ membership card upon withdraw from the Club. (* see "About withdrawal procedures" separately)
Article 12 (Visitor)
1 A guest who is accompanied by a member of the Club (hereinafter referred to as "Visitor") may use the Club facility. In this case, the visitor must pay a facility-use fee determined separately by the Club, and such visitor shall be deemed to have the same rights and obligations as the accompanying member with respect to the use of the Club facility. (However, the Club shall give preference to members over such visitors during busy hours.) The Membership Regulations shall also apply to all visitors.
2 As a general rule, use of facility as a visitor is permitted for one time only.
Article 13 (Termination of Membership)
In the event any member of the Club falls under any one of the following, such member shall be requested to withdraw from the Club. The membership card of such member shall be null and void and shall be returned to the Club immediately.
1 Fails to pay the membership fee for more than two (2) months. (Any member who falls behind in the payment of the membership fee for two (2) months shall be deemed to have withdrawn from the Club. However, the Club shall take such delinquent balance as the unpaid fees and charge such member for delinquent balance.)
2 Falls behind in the payment of membership fee by the date and/or method that the Club stipulates.
3 Fails to observe the Membership Regulations, Terms of Service, and other rules of the Club and fails to cure such violation in spite of a caution or warning by the Club.
4 Damages the Club's reputation and disrupts public order at the Club.
5 Submits false statements at the time of enrollment as a member of the Club.
6 On the death of a member (dismissal or bankruptcy for the corporate membership)
7 A member of gangster, and/or in close relationships with gangster or a member of gangster.
8 Otherwise commits an act that is inappropriate for the purposes of the Club.
Article 14 (Damages)
1 The Club shall not be responsible for any damages relating to personal injuries and/or property damage suffered by a Club member or any third party in connection with the use of the Club facility. The above shall apply to any visitor who is accompanied by a Club member.
2 In the event a Club member causes damage to the Club or any other third party in connection with the use of the Club facility, such member shall immediately assume responsibility for such damages. In the event any visitors who is accompanied by a Club member, causes the foregoing damage, such member shall be responsible for such damages jointly with such visitor.
3 However, the above provisions shall not apply to an accident or damage determined to be in responsible by the Club and/or defects of equipment.
Article 15 (Theft)
The Club shall not be responsible to any Club member for any damages due to theft during such member's use of the Club facility.
Article 16 (Lost and found)
1 The Club shall not be responsible to any Club member for any damages or loss during such member's use of the Club facilities.
2 The Club shall store lost articles for a period of one (1) month and shall dispose of such items upon expiration of such period.
Article 17 (Prohibitions)
1 Consumption of food and/or smoking in unauthorized areas.
2 Training under the influence of alcohol

4 Bringing food or beverages, hazardous materials, or pets onto the Club premises.
5 Any act that inconveniences other guests, including gambling, solicitation, sales activities, and any other similar acts.
6 Unauthorized photography, audio and video recording.
7 Unauthorized requests for another member's cooperation in answering questionnaires.
8 Any act that defames or slanders others.
9 Violent or threatening behavior against others
10 Any act that offends public order and morals, including sexual harassment, voyeurism, and sexual exposure.
11 Writing graffiti on the building or interior of the club facilities.
12 Utterance of violent remarks while training.
13 Excessive noise or vibrations from intentionally dropping weight training equipments on the floor.
14 Entrance to the unauthorized area.
15 Any act considered as business interference.
16 Changing the Club facility installations and settings (including but not limited to ventilation, lightings, sounds, and audio equipments) without getting the Club’s authorization.
17 Solicitation of retirement for employees and stakeholders of this Club, employment placement to other companies, withdrawal and other similar acts.
18 Any other acts in contravention of the purposes of the Club.
Article 18 (Non-business day)
The Club shall be closed during the year-end and New Year holidays, and due to unavoidable circumstances, such as statutory inspections and repairs of the Club facility.
Article 19 (Abolition and restricted use of the Club facility, equipment, and services)
1 In the event of extraordinary natural phenomena, enactment, improvement or elimination of legislation, administrative direction, significant change of social conditions or any other compelling reasons, the Club may, in whole or in part, abolish its facility, equipment, or services or restrict the use thereof.
2 In the event of renovation, reconstruction, or improvement of the Club facility and equipment, or if deemed necessary for the management of the Club, the Club may, in whole or in part, abolish its facility and equipment or restrict the use thereof or provision of services. Such notice shall be posted in, our company’s internet HP, prominent places in the facility of the Club, and/or in documentation.
3 In addition to the preceding paragraph 1 and 2, if absolutely necessary for the management of the Club, the Club may close facility operations upon prior notice. Such notice shall be posted, in, our company’s internet HP, prominent places in the facility of the Club, and/or in documentation, except special closing due to unavoidable circumstances.
4 In the event of the foregoing paragraph 1 through 3, a Club member shall not make a claim for damages against the Club.
Article 20 (Change of Registration Fee, Membership Fee, Ticket Fee)
The Club may modify its registration fee, membership fee, ticket fee to be paid by Club members under this Membership Regulations for various reasons. In the event of any change in such fees, the Club shall provide notice of the details in the company’s HP, prominent places in the facility of the Club, and/or in documentation, at least one (1) month in advance in principle.
Article 21 (Terms of Use)
1 Terms of Use for the Club shall be established separately.
2 Club members shall be obliged to comply with such terms of Use.
Article 22 (Disputes)
All disputes arising out of or in connection with this Membership Regulations shall be settled in arbitration of district court of Tokyo.
Article 23 (Validity of the Membership Regulations)
1 The Membership Regulations shall become effective on March 16, 2003. (Revised on October 1, 2012 Jun 1, 2018)
2 The Membership Regulations may be amended from time to time as appropriate. Such amendments shall be reported to Club members, in principle, be posted, in, our company’s internet HP, prominent places in the facility of the Club, and/or in documentation. The effect of such amendments shall be binding on all Club members, and all Club members shall comply with such new Regulations without objection.
